  • The penalty for possessing less than one gram of cocaine may include incarceration in state jail for 180 days to 2 years and fines of up to $10,000.
  • For less than 4 grams but more than 1 gram, the charge is usually a third-degree felony, including jail time of 2-10 years and fines of up to $10,000.
  • For more than 4 grams but less than 200, a second-degree penalty charge typically includes jail time of 2-20 years and a fine of up to $10,000.
  • For more than 200 grams but less than 400, a first degree penalty charge carries jail time of 5-99 years in state prison and a fine of up to $10,000.
  • For more than 400 grams, the charge may be upgraded to an "enhanced" first degree felony, which may feature 10-99 years in state jail and a fine of up to $100,000.
